Policies And Services Guidelines for
Virtual Hosting and Dedicated Servers.

The e-SoftHosting.com Internet Services provides web hosting
to people all around the world. We have the responsibility
to protect each client and provide them with the best services
available. The following guidelines were designed to insure
these services.
Content:
All services provided by e-SoftHosting.com Internet Services
may be used for lawful purposes only. Transmission, storage,
or presentation of any information, data or material in violation
of any United States Federal, State or City law is prohibited.
this includes, but is not limited to: copyrighted material,
material we judge to be threatening or obscene, or material
protected by trade secrete and other statue. The subscriber
agrees to indemnify and hold harmless e-SoftHosting.com Internet
Services from any claims resulting from the use of the service
which damages the subscriber or any other party.
Note: Pornography and sex related merchandising
are prohibited on any e-SoftHosting.com server. This includes
sites that may infer sexual content, or Link to adult content
elsewhere. This is also true for sites that promote any illegal
activity or content that may be damaging to e-SoftHosting.com
servers or any other server on the internet. Links to such
materials are also prohibited.
Examples of non acceptable content or links are (but not
limited to):
Pirated software
Hackers programs or archives
Warez Sites
Adult Sites
Unauthorized use of MP3's
The e-SoftHosting.com will be the sole arbiter as to what
constitutes a violation of this provision.
IRC
We currently do not allow IRC, egg drops, or IRC bots to be
operated on our servers. No files can be housed within an
account with any refference to IRC or likeness.
Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from a e-SoftHosting.com
server or using an email address that is maintained on a e-SoftHosting.com
machine is prohibited. The e-SoftHosting.com will be the sole
arbiter as to what constitutes a violation of this provision.
Server abuse:
Any attempts to undermine or cause harm to a e-SoftHosting.com
server or customer of e-SoftHosting.com is strictly prohibited.
Any Sub Networks of e-SoftHosting and dedicated servers must
adhere to the above policies.
Liability:
The e-SoftHosting.com is in no way responsible for down time
either resulting from a users actions, or natural fluctuations
in internet consistency. The e-SoftHosting.com will however,
do everything within it's power to assure that each and every
client site is up as consistently as possible.
Refunds:
With the exception of plans including 30 days money back (shared
hosting only), refunds will be posted for FULL months only.
Notice of cancellation must be given before the month in question
begins. Setup fee is NON refundable. $15.00 will be deducted
from the money refunded if the users domain was registered
via e-SoftHosting.com free domain registration period.
Cancellation
The easiest and most common method of submitting an account cancellation is by doing so by e-mail (info@esofthosting.com).
For security reasons, the following information must be included with a cancellation submitted in this manner:
-Account ID
-Current Password
-Signature
If any of the above information is absent, the cancellation can not be accepted. No other methods accepted To safegaurd against unauthorized account cancellations, no other means of cancellation will be accepted. Under no circumstances will E-Soft Tecnnologies of Orlando accept an account cancellation over the telephone.
Background Processes:
There will be no unauthorized background processes. Any will
result in immediate termination of account without prior notification.
99.9% Uptime Guarantee:
The uptime guarantee pertains to network uptime only. It does
NOT apply to any of the services on the server, or the server
itself.
Fair Use of Resources:
Sites staying within the transfer limitations may still be
subject to review if using more than 15% of total system resources.
The average server houses a minimum of 200 sites with no substantial
load, making this a very fair number.
Account Setup and charging:
Regardless of account billing date, account will be charged
on the day the order is processed and charged the farthest
billing period away. Billing cycles are on the first and 25th
of every month.
Domain Transfer Relevancy:
Domain transfer is the sole responsibility of the customer.
The customer will not receive a refund for domains not being
transferred as this is not the responsibility of e-SoftHosting.com,
but that of the account holder.
Check Orders:
Accounts which wish to be setup by check will only be setup
when the check is received by e-SoftHosting.com.
Disabling of accounts due to overdue payment:
When lack of payment reaches 30 days of invoice, accounts
are disabled.
Termination of accounts due to overdue payment:
When lack of payments reaches 45 days after invoice, account
will be terminated and all information will be deleted from
the machine.
Parked Domains:
No additional charges are applied in this case. This is a
FREE service.
Virtual Domains:
Addional domains that point to a sub folder (Virtual Domains)
are $10 per domain per month. This is non-refundable.
Courtesy services for customers:
All services such as backup and cpanel are provided for courtesy
for the customer. It is the sole responsibility of the customer,
however, to maintain their own backup of the site. The e-SoftHosting.com
is not responsible for lost information for hosted sites and
dedicated servers or for bugs via outside programmers from
e-SoftHosting.com. (example, Cpanel is not associated with
e-SoftHosting.com programmers).
Payments
As of September 01- 2003, any hosting payment not received
by us within two weeks of that months invoice will cause an
automatic shut down of the said website. The website will
not be restored until payment is made. No exceptions will
be made unless we are contacted within the two week period
and arrangements are made and approved by us.
This can be avoided by setting up automatic payments on a
credit card or by paying for hosting in advance in six or
twelve month increments. The free months hosting for advance
payments will apply, (1 month free for paying for 5 months
in advance and 2 months free for paying for ten months in
advance).

Terms Of Service are subject to change without any prior
notification
Terms Of Service is equal to Contract
By opening an account the individual(s) responsible for the
site agree to all of the Terms and Conditions without question.
Anything not listed in the Terms of Service is open to interpretation
and change by e-SoftHosting.com administrators without prior
notification
Recovery of damages will in no way exceed amount of fees
collected
All prices, with the exception of the 30 day money back guarantee,
are non-refundable and non-negotiable.
If any terms or conditions are failed to be followed it will
result in grounds for account deactivation without prior notification
required.
